By accessing or using InstantInsight ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

3. Description of Service

InstantInsight is a Software as a Service (SaaS) platform that provides AI-powered automated data analysis. The Service allows users to upload data files (Excel, CSV) and receive instant insights, visualizations, forecasts, and actionable recommendations.

• Pattern detection and anomaly identification
• Predictive forecasting
• Actionable business recommendations
• PDF and CSV export functionality

4. User Accounts

4.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Security

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with this security obligation.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity.

5. Acceptable Use Policy

5.1 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload malicious code, viruses, or any harmful software
• Attempt to gain unauthorized access to the Service or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts or bots to access the Service
• Resell, sublicense, or redistribute the Service without authorization
• Upload data containing personally identifiable information (PII) of third parties without consent
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Violate any intellectual property rights

5.2 Consequences of Violation

Violation of this Acceptable Use Policy may result in immediate termination of your account and legal action.

6. User Data and Privacy

6.1 Data Processing

When you upload data files to the Service, we process them using AI to generate insights. We do NOT store your original uploaded files. Files are processed in memory and immediately discarded after analysis.

6.2 Data Retention

We store only the analysis results (insights, charts, recommendations) in our database. Retention periods vary by subscription plan:

• Free Plan: 7 days
• Pro Plan: 30 days

6.3 Privacy Policy

Our collection and use of personal information is described in our Privacy Policy.

6.4 User Responsibility

You are solely responsible for:

• The accuracy and legality of data you upload
• Obtaining necessary permissions to use and analyze the data
• Ensuring compliance with applicable data protection laws (e.g., GDPR, CCPA)
• Not uploading sensitive personal information of others without consent

7. Subscription Plans and Payment

7.1 Plans

We offer the following subscription plans:

• Free Plan: Limited features, 3 analyses per month, 7-day data retention
• Pro Plan ($12/month): Full features, 50 analyses per month, 30-day data retention

7.2 Billing

Pro Plan subscriptions are billed monthly in advance. Payment is processed through our third-party payment processor.

7.3 Refunds

We do not offer refunds for partial months. If you cancel your subscription, you will retain access until the end of your current billing period.

7.4 Price Changes

We reserve the right to change our pricing. We will provide at least 30 days' notice before any price increase takes effect.

8. Intellectual Property

8.1 Service Ownership

The Service, including all software, algorithms, designs, text, graphics, and other content, is owned by Binee Labs and is protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain all rights to the data you upload. By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service.

8.3 Trademarks

"InstantInsight" and "Binee Labs" are trademarks of Binee Labs. You may not use these trademarks without our prior written permission.

You agree to indemnify, defend, and hold harmless Binee Labs, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your data uploaded to the Service
• Any illegal or unauthorized use of your account

12. Service Modifications and Termination

12.1 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason.

12.2 Termination by You

You may terminate your account at any time from your account settings. Upon termination, your data will be deleted according to our retention policy.

12.3 Termination by Us

We may terminate or suspend your access immediately, without prior notice, if you violate these Terms.

13. Third-Party Services

The Service uses third-party services including:

• Supabase: Database and authentication
• OpenAI: AI analysis and insights generation
• Vercel: Hosting infrastructure

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of third-party service providers.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Gumi-si, Gyeongsangbuk-do, Republic of Korea.

14.3 Informal Resolution

Before filing any formal claim, you agree to first contact us at contact@instantinsight.net to attempt to resolve the dispute informally.

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and Binee Labs regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 Language

These Terms are provided in English. In case of any conflict between the English version and any translation, the English version shall prevail.
